I have long wondered what the "rules" are for using material from games in work made by fans. Everyone has heard of "Fair Use," but how many people could actually tell what qualifies? If someone takes an image/sprite from a game and uses it in a signature banner on a forum, is that "okay"? Would Square Enix be upset, even if it is?

What about something more serious. What if somebody wanted to make a game based on some aspect of a video game? For example, what if somebody liked Triple Triad from Final Fantasy VIII so much they made an online version of it (it's happened already). Is that fair use? Does Square mind?

I ask primarily because I had an idea for a relatively small browser game based on one of Square Enix's video games, and I wouldn't want to do something that would cause legal issues. If there is some sort of general guideline for what's acceptable, that would help me know what my options are. Beyond that, I'm also just curious because I see so many things made by fans, and I never know what the legal status of them is.

Does anyone have knowledge or experience which could help shed light on the matter?

I think as long as you give the rights to the characters and places and what you based it upon to it's rightful owners that should be fine.

I mean you, you just have to say where the rights go to that's mostly it have you seen you tube ? Have you ever read what's under the video ? Anyway if they use images and characters that are not there's they have to give out the rights to there rightful owners.

As long as you do that your square dude or dude it.

What to do about this attitude? The posts can be reported ("Do not distribute or request copyrighted content or links to copyrighted content, this includes but is not limited to soundtracks, games, movies, manga/comics, etc."), but they still keep appearing all over the place.
If I want something, then I import it.

I apologize for posting those items, I was not trying to rip anyone off, I personally only use those websites while waiting for the money and/or the release date to purchase the manga/anime to support the artists who create them

I haven't read any of the manga yet, to be honest. I have watched the anime(I wasnt going to just buy it without knowing that it was worth it) and am waiting for the funds to buy it (student loans take up almost all of my money). I only posted those items as an alternative, but I did post a warning about how legal it was... I personally am only using those websites to watch anime's that dont yet have dvd's, as they are released weekly (guilty crown, for a while, and now hyouka). i only streamed the last episode of pandora hears, the rest was watched at a friend's using his dvd set

and I wasn't just referring to pandora hearts... I hate when stories are unfinished, and I know that my purchases might not stop that, but I still try to support authors so that they can finish their stories. Thats why, even tho I read Naruto weekly on these websites, because it takes awhile for the weekly chapters to be published, I still have a large collection of the manga. And I intend to do the same with Pandora Hearts. But no summer jobs have worked out and my steady job at school won't be available until september, meanwhile I still have monthly loan payments... I kind of can't afford it right now.

The company is 100% right. This kind of artwork shouldn't be used without permission from SQUARE ENIX, even if you are the only one that is going to use the finished product.

I'm pretty sure none of these guys have the license, and also cosplayers who make items to dress like certain blockbuster characters would be doing illegal activities then...

i'm not trying to make money like these guys are.... so i really don't see a problem if im pretty much advertising for them and not making a profit.

But i duno about these situations thats why i tried to apply for a limited license from na.licensing@square-enix.com but no reply yet...

I think it's just decalgirl being cautious, so you might just have to find another place to get your decal. You're right, there's so many fan things being made that people sell happily, and S-E thus far are secure enough in their own position to not be bothered by hobbyists ripping off their trademarks.

I mean, I think the last thing I recalled about S-E laying the smackdown was on replica weapons being sold (I think in Europe? Maybe France?) a couple of years back, but that's it...

There's this bi-yearly event in Japan called Wonderfest. This is an event where Garage Kits that are more or less fan made and designed, can be sold in limited quantities for that one event with the blessing of whatever show/game creators and no strings attached. Some of these sculptors do end up working for figure companies if they're good enough. These are often characters/scenarios that would get no treatment otherwise.

Have they deleted a video that you uploaded to YouTube? I don't think permission is required as most gameplay videos on YouTube were uploaded without permission, the game companies usually don't mind, unless you are using them for commercial purposes.

In Android Market appeared illegal copy of your card game Tetra Master, which is sold for money, uses the mechanics of your game your arts, names, music from the world of Final Fantasy. I'm a fan of Final Fantasy series and a programmer in the games development studio. I find outrageous and unacceptable actions of authors of this game. I hope you take action.

These games are being listed as homebrew, but are actually unauthorized copies of established intellectual properties and are burned to CD-Rs. They have also sold counterfeit Final Fantasy games but have since "sold out" of them.

I wanted to to know if square-enix ever licensed any of their FINAL FANTASY OST tracks to use in motion pictures!?

I really dont know where to put this so I try here, just move it if it is not ok.

Since like a week or so I get Ads with a Picture in the background that is clearly from Advent Children. Maybe Square wants to take a look if that is approved or not. From the text, it could be a 18+ game.

I've been trying to find a way over Google, and had no luck, does anyone happen to know?

I was playing around on the Google Play store Tuesday night when I stumbled across a game called "Dance Fantasy" by Geod Studios (TRAN TRUC on iOS) and was a bit shocked to find a model of Lebreau from FFXIII in the game preview images and trailer. Turns out she is a playable character who has been renamed "Orchid" and I can find no credit given to SE. The game is capable of making money through in-app purchases, and I'd like to make sure SE is aware someone is using their material in such a manner, so help would be greatly appreciated.

Maybe the moderator could pass it along to someone who could do something..?

This "rapper" called Nextale Nailze used "A Fleeting Dream"(Zanarkand Ruins Theme/Someday the Dream Will End) from Final Fantasy 10, put his lyrics & cheap sound effects over it and copyrighted it.


Now youtube associates the original "A Fleeting Dream" with him, giving him ad money and exposure.

I notice during "L'isola dei Famosi" (an Italian broadcast by Mediaset produced one of the most important Italian TV channel) the Track Final Fantasy XIV. I suppose that these Track are covered by copyright and suppose also that Mediaset has not paid for these Track !!! Since it does not appear any recognition. I would then make a complaint to the proper authorities! Please do not want to hear and see the music of my great passion in this program idiot !!!

A game recently released by a game studio called "Fabraz" contains a likeness of a character from the "Chrono Trigger" game series, Lucca.

The game's name is "Planet Diver"


Lucca is purchasable through the in-game shop under the name "Mech Suit"
